Quick Summary
By downloading, installing, or using the NextUp mobile application or website, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use NextUp. These terms constitute a legally binding agreement between you and NextUp ("we," "us," or "our"). We reserve the right to update these terms at any time. Continued use after changes are posted constitutes acceptance of the updated terms.
You must be at least 13 years of age to use NextUp. Users between 13 and 17 must have verified parental or guardian consent, particularly for biometric features. By using NextUp, you represent that you meet these age requirements and that all information you provide is accurate and truthful. We reserve the right to terminate accounts found to be in violation of these eligibility requirements.

The NextUp queue system operates on a first-come, first-served basis. By joining a queue, you agree to the following:
NextUp and all associated branding, logos, software, features, and content are owned by NextUp and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the application for personal, non-commercial purposes.
Your content: By submitting photos, performance data, or other content to NextUp, you grant us a worldwide, royalty-free license to use, store, and display that content solely to provide and improve our services. You retain ownership of your content. We will never sell your personal content to third parties.
You may not use our name, logo, or branding in any manner without our prior written consent.
AI coaching, performance analysis, and recommendations provided by NextUp are for informational and entertainment purposes only. They do not constitute professional sports coaching, medical advice, or fitness guidance. NextUp makes no representation that AI-generated content is accurate, complete, or appropriate for your specific circumstances.
Always consult a qualified coach, trainer, or medical professional before making changes to your training regimen. NextUp is not liable for any injury, loss, or damages resulting from acting on AI-generated recommendations.
Pro Player and Court Manager subscriptions are billed monthly or annually as selected at checkout. By subscribing, you authorize us to charge your payment method on a recurring basis.
All payments are processed securely through Stripe. We do not store payment card information on our servers.
You may delete your account at any time via Settings → Delete Account. Deleting your account cancels any active subscription immediately (no refund is issued for the current billing period).
We reserve the right to suspend or permanently terminate your account, with or without notice, if you:
Upon termination, your right to use NextUp immediately ceases. We will process your data deletion request in accordance with our Privacy Policy.
You agree to indemnify, defend, and hold harmless NextUp and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the platform; (b) your violation of these Terms; (c) your violation of any third party's rights; or (d) any content you submit to the platform.
NextUp is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure.
To the maximum extent permitted by applicable law, NextUp shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising from your use of the platform. Our total aggregate liability for any claim shall not exceed the greater of (a) the amount you paid to NextUp in the 12 months preceding the claim, or (b) $100 USD.
We encourage you to contact us first at legal@thenextup.app to resolve any dispute informally. If we cannot resolve a dispute within 30 days, you agree that any claim arising from or relating to these Terms or the NextUp service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules — not in court, and not as a class action.
Exception: Either party may bring small claims court actions if the dispute qualifies. You may also opt out of arbitration within 30 days of first accepting these Terms by emailing legal@thenextup.app with "Arbitration Opt-Out" in the subject line.
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles. For disputes not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Wilmington, Delaware.
